What Happens If I get a DUI in Chico CA?

After you get pulled over or once you are stopped on suspicion of driving under influence or drunk driving, you would be asked to submit to a breathalyzer, sobriety test or blood test. What happens next will depend on the test results. Your blood alcohol limit may be within the permissible range and you will be allowed to go. You may fail the tests in which case you would be arrested. Here is a stepwise guide to answer your question: what happens if I get a DUI?

  •       If you are found to be under influence or drunk beyond the permissible limit of alcohol in blood, then you would be arrested, you would be taken to the nearest or local police station and a  mugshot or your photograph would be taken along with your fingerprints. When you are locked up, someone you know may bail you out and you may be released immediately. In some states, you are required to stay in jail or holdup till you are sober.
  •         As you are booked for DUI, you will be served a summons or a ticket. This will tell you when you have to appear in court. You must appear in court, in person and you will have to accept or contest the charges. Denying charges is not wise if you have failed the sobriety test or if you have declined to use the breathalyzer. Police vehicles have cameras on their dashboards so there is visual evidence against you at the time of arrest.
  •       You will be convicted by the court and the sentence may just involve losing your driver’s license. It could also involve a fine. If you are a first time offender then the sentences are usually lenient. Repeat offenders can expect much harsher sentences. You will lose your driving privileges for some time. In some cases, you may be allowed to drive to and from school or work but there will be serious restrictions on where you can drive, when, with whom and in what condition.
  •        The fine you are supposed to pay will be determined by many factors including if you have damaged any property, injured any person, cooperated with the cops, assaulted anyone or have been a nuisance in public.
  •         Some states require even first time offenders to serve a jail term. A day or two is typical but repeat offenders are sentenced for several days. If there is no jail term, you would be put on probation. Failing to comply with the probation terms will invariably warrant a jail term.

There are a few long term implications of being charged and convicted with DUI. You may have to pay higher auto insurance and in some cases you may lose your job or you may have to sign up for therapy to address your alcoholism.
