Misdemeanor Criminal Court Process Chico CA
The arraignment is your first court appearance. At the arraignment, you will be told the charges that you are now facing. At the arraignment, you or your attorney will enter a plea. You have three possible plea options – Guilty, Not Guilty, and No Contest. We highly encourage that you plead Not Guilty, especially if you have not yet contacted a criminal defense lawyer. The reason is because you might not know the full consequences of your guilty plea.
“Pre-trials” are court dates to update the judge on the status of your case. At this hearing, you or your misdemeanor attorney can negotiate with the district attorney on a plea agreement, set the case for trial, argue motions and enter a plea. If a plea agreement is reached, you will enter your plea and the judge will sentence you. If no plea agreement is reached, your case will be set for your trial date.
Although most cases are resolved prior to trial, it is your choice whether or not you wish to have your case decided by a jury or judge. If you elect to have a jury trial in California, 12 jurors will be selected to hear your case. The process starts with jury selection, and then opening statements will be given by both the state prosecutor and your defense attorney. The prosecution will then present its case and evidence against you. Witnesses will be called to testify, and your attorney will have an opportunity to cross-examine them. At the conclusion of the prosecutor’s case, your attorney will have the option of putting on its own case. He may call his own witnesses and experts to testify. After both sides rest, there will be closing arguments from both sides. The jury will go back into the jury room and deliberate. In order to sustain a guilty verdict, all jurors must be convinced beyond a reasonable doubt that you are guilty.
Depending on the type of misdemeanor, the penalties can be harsh. You can serve up to 1 year in jail for a misdemeanor charge. Some misdemeanor charges can require you to register as a sex offender, others can make you take counseling, loss of driving privilege. In addition, you can be put on probation for a period of 5 years and have a significant amount of fines.

Gold standard for professionalism and ethics. Extremely knowledgeable and proficient in handling complex cases. Attorney Javellana took painstaking hours building a civil case, (co-ownership/property rights) and then he presented overwhelming evidence at trial. Mr. Javellana was on point for 3 days at trial where he tactfully asserted a powerful presence in the courtroom and systematically picked apart the defendents and he was quick to respond to the dirty trickery of the defense attorney with undisputable legal arguments. As a result of Mr. Javellana's detailed and powerful representation, the opposing side had no chance. Mr. Javellana was extremely organized and detail oriented throughout. Mr. Javellana won the case across multiple points and most impressively he obtained a permanent injunction against the opposing party. Additionally, Mr. Javellana, represented me with two other cases where his professionalism and his relentless tactical drive continued with successful results. I highly recommend Mr. Javellana. J.M
