The first thing that needs to be considered is the definition of possession, and in the state of California, there is a rather expansive definition of possession. It may include, not only being in physical contact with the controlled substance but also having it in your general control. When many people think about controlled substances, they think about hard drugs, such as heroin, cocaine and methamphetamine (Health and Safety Code § 11377). They may also think of common drugs, such as marijuana. The fact is, however, even prescription medications may be considered a controlled substance. Of course, if you have a legal prescription for the medication, you will be exempt from this charge but if you are in possession of prescription drugs and do not have a prescription for them, you could be charged with misdemeanor possession of controlled substance.
