In either case, a misdemeanor or felony charge may be considered, depending upon the specifics of the case.

One of the types of auto theft is grand theft auto. According to California law, grand theft auto occurs when an automobile is taken illegally from another individual without the intent to return it. Another type of auto theft is the unlawful taking of a vehicle. This is defined rather broadly, such as taking the vehicle without the consent of the owner or driving a vehicle that belongs to somebody else. This can either be done to permanently or perhaps even temporarily, depriving ownership of the vehicle from the proper owner.

If you have been charged with unlawfully taking a vehicle, there may be certain circumstances in which the consequences could be severe. As an example, if you were to take a vehicle that belonged to the fire department, an ambulance or a marked police vehicle, you may be punished more severely if you are convicted. On the other hand, if you are joyriding, you may still be convicted of the crime but the punishment may be less severe than if you were stealing a police car or ambulance.

Carjacking (California Penal Code § 215 PC) is also another type of auto theft that should be considered. This is considered to be a serious crime and it may carry heavier punishment in some cases. Carjacking is taking a vehicle from the immediate presence of the owner by fear or force. In many cases, the owner is forced out of the vehicle with threats of violence.
