What is a first offense DUI?
Getting behind a wheel drunk is no minor decision, and the consequences for even a first-time offense — meaning the defendant has no other DUI charges — are severe. Though the defendant is still innocent of charges until proven guilty, their license will be suspended until the hearing.
The defendant is not guilty until three components are met:
- The officer had probable cause to pull the defendant over.
- The defendant exceeded the state’s BAC level limit or refused to conduct a chemical test.
- The arrest was lawful.
Can I go to jail for a first-offense DUI?
If these are proven in court, then the first-time offender will have approximately $1,000 in fines, may be charged with up to six months in jail, will have an extra four month license suspension and will be placed on probation. All offenders must also complete an 18 to 30 month alcohol awareness program and will be placed on an expensive SR22 auto insurance.
Do I need an attorney for a first-offense DUI?
If the defendant displayed obvious signs of drunk behavior, then a lawyer will not be of much use to them. In certain cases where the BAC level was .09 or .10, then, with a lawyer’s help, the charges may be reduced to wet reckless driving, or just reckless driving. A wet reckless is where alcohol was proven to be involved in the arrest. These reduced charges will most likely not involve jail time.
